IMSCA Call to Action on SB 1480!
As we are all well aware, the Illinois General Assembly is in lame duck session this week. Legislation is moving very quickly including SB 1480. SB 1480 is on its second reading in the House. This bill will likely see additional action between now and tomorrow at noon. SB 1480 proposes policy changes that will have a detrimental impact on the Illinois business community, including the construction industry.

SB 1480 as amended proposes changes impacting employer hiring practices and policies regarding the hiring of individuals with criminal backgrounds. 
 
Language included in this bill that will negatively impact ECA / IMSCA members includes:
  • Forbids an employer from using information related to a criminal conviction in making employment decisions, except in specified circumstances. This includes decisions regarding hiring, firing, recruiting, promoting, renewing employment and training for an apprenticeship.

  • Requires businesses with 100 or more employees to obtain an Equal Pay Certificate by paying a $150 filing fee and submitting an equal pay compliance statement.

  • Prohibits the state from contracting with any business of 40 or more full-time employees unless the business has an Equal Pay Certificate.

  • The Equal Pay Certificate is in addition to regulations employers are already required to comply with including: IL Equal Pay Act, the federal Equal Pay Act, IL Human Rights Act, and the Civil Rights Act. All of these Acts have their own enforcement mechanisms and penalties.
Due to the additional requirements SB 1480 as amended places on employers, IMSCA is OPPOSED to SB 1480. It is important that IMSCA members contact their State Representatives and State Senators to register their opposition. Please call your state legislator and encourage a “NO” vote on SB 1480 as amended. If you do not know who your legislator is, you can look them up by clicking this link:
